Terms and Conditions for Users

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder, as applicable. This electronic record is generated by a computer system and does not require any physical or digital signature.

These Terms and Conditions ("Terms") govern your access to and use of the Delulu Maps mobile application, website, services, features, credits, navigation experience, and related offerings, collectively referred to as the "App", "Platform", or "Services".

Delulu Maps is currently an India-first MVP and is operated from India. In these Terms, "Delulu Maps", "we", "us", or "our" refers to the Delulu Maps app, its founder, team, operators, and authorised representatives.

By downloading, accessing, creating an account, purchasing credits, or using Delulu Maps, you agree that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree with these Terms, please do not access or use Delulu Maps.

1. About Delulu Maps

Delulu Maps is a discovery-based navigation app that helps users explore places through surprise-based navigation. Instead of choosing an exact destination, users may select a distance range, vibe, or category, and the App may generate a navigation experience based on such preferences.

Delulu Maps is designed for discovery, exploration, and entertainment. It is not a transport service, ride-hailing service, emergency service, safety service, travel agency, tour operator, or guarantee of any place, route, destination, experience, or outcome.

Delulu Maps only helps you navigate and discover. Your real-world decisions, safety, surroundings, and lawful access to places remain your responsibility.

2. Eligibility

By using Delulu Maps, you confirm that:

  • You are at least 18 years old; or
  • You are using the App with the consent and supervision of a parent or legal guardian;
  • You are legally capable of entering into a binding agreement; and
  • You are not restricted by any law, regulation, court order, or authority from using the App.

Delulu Maps is not intended for unsupervised use by minors. If we become aware that a minor is using the App without appropriate consent or supervision, we may restrict, suspend, or terminate access to the App.

3. User Account

To use certain features of Delulu Maps, you may be required to create an account or provide details such as your name, email address, login information, or other information requested during registration.

You agree to:

  • Provide true, accurate, current, and complete information;
  • Keep your login credentials confidential;
  • Not share, transfer, sell, or assign your account to any other person;
  • Be responsible for all activity that takes place through your account; and
  • Inform us immediately if you suspect unauthorised access to your account.

Delulu Maps will not be responsible for any loss or damage caused by unauthorised use of your account due to your failure to keep your login details secure.

We may suspend, restrict, or terminate your account if we believe that the information provided by you is false, misleading, outdated, incomplete, or used for fraudulent or unlawful purposes.

4. Services Provided by Delulu Maps

Delulu Maps may provide:

  • Location-based discovery and navigation experiences;
  • Vibe-based or category-based place suggestions;
  • Distance-based exploration features;
  • Surprise destination or route-based navigation;
  • Credit-based access to certain navigation or app features;
  • App support, notifications, and related services; and
  • Any other feature introduced by Delulu Maps from time to time.

Delulu Maps is currently an MVP. Some features may be experimental, limited, incomplete, changed, paused, removed, or improved over time.

At this stage, Delulu Maps does not provide public photo-sharing, public stories, user-to-user chat, social posting, or community feed features unless specifically introduced in a later version.

5. Location-Based Services

Delulu Maps requires access to your device location to provide navigation and discovery-related features.

By using location-based features, you understand and agree that:

  • The App may use your device location to generate or support navigation experiences;
  • Location accuracy depends on your device, GPS signal, internet connection, map provider, and other technical factors;
  • Routes, distances, time estimates, and destination information may not always be accurate, complete, current, accessible, safe, or suitable; and
  • You are responsible for using your own judgment while following any route, suggestion, or destination shown in the App.

You may disable location access through your device settings. However, some features of Delulu Maps may not work properly without location permission.

6. Navigation and Safety Disclaimer

Delulu Maps provides navigation assistance and discovery-based suggestions only. The App does not guarantee that any route, road, area, venue, destination, or suggested place is safe, open, lawful to access, suitable, available, or appropriate for you.

You are solely responsible for your personal safety, travel decisions, surroundings, traffic-law compliance, lawful access, and decision to continue, pause, stop, or exit a route.

Do not enter private, restricted, dangerous, closed, or prohibited areas. If a route, area, or destination feels unsafe, inaccessible, unlawful, uncomfortable, or inappropriate, you should not continue.

Delulu Maps is not responsible for accidents, injuries, delays, losses, fines, penalties, disputes, inconvenience, unsafe situations, or harm caused by your decision to follow, ignore, modify, or rely on any route, suggestion, destination, or information shown in the App.

7. No Emergency or Safety Monitoring

Delulu Maps is not an emergency service and does not monitor your real-time safety. The App does not replace emergency services, police assistance, medical assistance, local authorities, personal safety precautions, road safety awareness, or responsible travel decisions.

In case of emergency, danger, accident, medical issue, threat, or distress, contact the appropriate emergency services or local authorities immediately.

8. User Conduct

You agree to use Delulu Maps only for lawful, personal, and responsible purposes. You must not use the App for illegal, unsafe, harmful, abusive, fraudulent, stalking, tracking, hacking, reverse-engineering, automated, or commercially exploitative activity, or to enter private, restricted, dangerous, closed, or prohibited areas.

We may suspend, restrict, or terminate access if we believe you have violated these Terms or misused the App.

9. Credits and Paid Features

Delulu Maps may use a credit-based system. Users may purchase credits and use them to access navigation experiences or other paid features.

Credits are digital units used only within Delulu Maps. They have no cash value outside the App, cannot be transferred or resold, and may be deducted when you start or use a paid feature. Credit requirements, packs, offers, discounts, and prices may change from time to time. Review the credit cost before starting any paid action.

10. Payments

Payments for credits or paid features may be processed through third-party payment gateways, app stores, banks, UPI providers, card networks, or other payment service providers.

Delulu Maps does not control third-party payment systems and is not responsible for payment failures, delays, bank issues, app store issues, card issues, UPI issues, or payment gateway errors beyond our control.

A credit purchase is completed only after successful payment confirmation is received by us or our payment service provider.

11. Refund and Credit Adjustment Policy

Credits once purchased are generally non-refundable, except where required by applicable law or where Delulu Maps decides to provide a refund or credit adjustment.

We may provide a credit adjustment where payment was successful but credits were not added due to a verified technical error, credits were deducted but a paid feature failed due to a verified App-side technical issue, duplicate payment occurred and was verified, or a refund is required under applicable law.

Refunds or credit adjustments may not be provided where you changed your mind after purchase, used the credits successfully, stopped or exited navigation voluntarily, could not complete navigation due to your device, internet, GPS, battery, weather, traffic, road condition, personal decision, or safety concern, or the experience did not meet your expectation.

For payment or credit support, contact delulumaps@gmail.com with your registered details, payment proof, transaction ID, screenshots if available, and a short description of the issue.

12. App Availability and Changes

Delulu Maps is provided on an "as is" and "as available" basis. We try to keep the App functional, but do not guarantee uninterrupted, error-free, accurate, or continuous access.

The App may be affected by maintenance, bugs, technical issues, internet, GPS, device, map provider, payment gateway, server, app store, legal, safety, operational, business, or other events beyond our reasonable control.

We may update, modify, suspend, discontinue, or remove any part of the App at any time.

13. Third-Party Services

Delulu Maps may rely on third-party services such as map providers, cloud hosting providers, analytics tools, payment gateways, notification services, authentication providers, and app stores. Your use of those services may also be subject to their own terms, policies, and practices.

Delulu Maps is not responsible for the accuracy, availability, pricing, actions, errors, downtime, or policies of third-party services.

14. App Store Terms

If you download Delulu Maps from Google Play Store, Apple App Store, or another app marketplace, your use of the App may also be governed by that marketplace's terms and policies. Those terms may apply to the extent required for your use of that store or platform.

15. Communications and Notifications

By using Delulu Maps, you agree that we may contact you through the App, push notifications, email, SMS, phone, WhatsApp, or other communication channels for account activity, app updates, payment or credit issues, navigation or feature alerts, customer support, safety or security notices, and important changes to these Terms or our policies.

You may manage certain notification preferences through your device settings or app settings, where available. Essential service-related communications may still be sent to you.

16. Privacy

Your use of Delulu Maps is also governed by our Privacy Policy. The Privacy Policy explains what personal data we collect, why we collect it, how we use it, how we share it, how long we keep it, and what rights you may have.

17. Device Permissions

Certain features may require permissions such as location, notifications, camera, photos, device information, or other access. You can manage permissions through device settings, but disabling them may limit or prevent features from working properly.

18. Intellectual Property Rights

All rights, title, and interest in Delulu Maps, including the app name, logo, brand identity, mascot, design, user interface, text, graphics, icons, features, software, code, content, product concept, and overall experience belong to Delulu Maps or its lawful owners.

You receive a limited, non-exclusive, non-transferable, revocable licence to use Delulu Maps for personal, lawful, and non-commercial use. You may not copy, modify, sell, distribute, reverse engineer, commercially exploit, scrape, mirror, or misuse the App or its branding without written permission.

19. Feedback and Suggestions

If you share feedback, suggestions, ideas, comments, or improvements, Delulu Maps may use them to improve the App without an obligation to pay you, credit you, or obtain further permission. You confirm that your feedback does not violate third-party rights.

20. Use Outside India

Delulu Maps is an India-first MVP operated from India. If you use the App from outside India, you are responsible for ensuring that your use is lawful in your location and for following local laws, road regulations, safety requirements, and restrictions. Some features may not work or be available outside India.

21. Disclaimers

Information, routes, recommendations, destinations, distances, time estimates, and suggestions are provided for general discovery and navigation purposes only. Delulu Maps does not guarantee availability, security, accuracy, completeness, reliability, safety, lawful access, suitability, or any specific experience or outcome.

You acknowledge that your use of Delulu Maps is at your own discretion and risk.

22. Limitation of Liability

To the maximum extent permitted by law, Delulu Maps, its founder, team members, employees, contractors, partners, service providers, and affiliates shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including personal injury, accidents, unsafe travel situations, loss of data, loss of money, loss of profits, travel delays, payment issues caused by third parties, inaccurate routes, or harm arising from your real-world actions or travel choices.

To the fullest extent permitted by applicable law, Delulu Maps' total liability for a claim arising from your use of the App shall not exceed the amount actually paid by you for the specific paid feature giving rise to the claim, or INR 1,000, whichever is lower.

23. Indemnity

You agree to defend, indemnify, and hold harmless Delulu Maps, its founder, team members, employees, contractors, partners, service providers, and affiliates from claims, losses, damages, liabilities, penalties, costs, or expenses arising from your use or misuse of the App, violation of these Terms, violation of law or third-party rights, unsafe or unlawful conduct, or decision to follow, ignore, or modify a route, suggestion, or destination.

24. Suspension and Termination

We may suspend, restrict, or terminate access if you violate these Terms, misuse the App, create risk, attempt fraud, abuse, hacking, or unauthorised access, if required by law or app-store policy, or if we discontinue the App.

Termination may result in loss of access to your account, credits, features, or data, subject to applicable law and our Privacy Policy. You may stop using the App at any time. Account-deletion requests are described in the Privacy Policy.

25. Changes to These Terms

We may update these Terms from time to time. If we make important changes, we may notify you through the App, email, website, or other reasonable means. The updated Terms will be effective from the date posted or notified. If you do not agree, stop using Delulu Maps.

26. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India, without affecting mandatory rights under the laws of the country or region where you are located.

For disputes, the parties shall first try to resolve the issue through good-faith communication by contacting delulumaps@gmail.com. If the dispute cannot be resolved amicably within 15 days, it may be resolved in accordance with applicable law and, subject to applicable law, by competent courts in India.

27. Final User Acknowledgement

By using Delulu Maps, you acknowledge that Delulu Maps is a discovery and navigation app; the App does not guarantee safety, accuracy, access, availability, suitability, or any specific experience; you are responsible for your own safety, surroundings, travel decisions, and lawful access; credits and paid features are governed by these Terms; and you have read, understood, and agreed to these Terms and the Privacy Policy.
